1. About Us and these Conditions
1.1. Hello and welcome to the world of DAZN. We are a subscription service that provides subscribers with access to a wide range of sports events from around the world as specified in Section 2.2 ("DAZN Service").
1.2. The DAZN Service is provided to you by DAZN Limited. DAZN Limited is a DAZN Group company, registered in the United Kingdom and having its registered office at 12 Hammersmith Grove, London, England, W6 7AP (“we", "us"). We (and not a third-party payment provider) are solely responsible for the provision of the DAZN Service and app.
Sky Switzerland SA ("Sky") is responsible for providing the technical infrastructure necessary for the provision of the DAZN Events on Sky (as specified in Clause 2.4), depending on your place of residence (according to your registration).
1.3. Please read these Terms & Conditions ("Conditions") before subscribing to the DAZN Service. These Conditions apply to the DAZN Service in the territories of Switzerland and Liechtenstein (“CH”). For the avoidance of doubt, any offers, promotions or discounts that you may receive may be subject to additional terms and conditions which either supersede or supplement these Conditions. In the event of a conflict between these Conditions and the additional terms and conditions, the additional terms and conditions shall prevail.
1.4. Any other service provided by DAZN Limited or another DAZN Group company that has its own terms and conditions, will be governed by those terms and conditions and will not form part of the DAZN Service (unless those terms and conditions expressly state otherwise).
2. DAZN Service
2.1. The DAZN Service can be streamed to a range of devices including Internet-connected TVs, computers, smartphones and other platforms. The DAZN Events auf Sky can be received via Sky’s Sky Switzerland OTT Platform (website und app).
2.2. The DAZN Service may be offered in different paid subscription plans. The cost & entitlements of which (such as access to sports content, functionality and/or any other features) will be outlined at sign-up or in other communications made available to you prior to purchasing the subscription plan (each a “Paid Subscription”). Certain sports events may only be available on a pay per view basis for which additional terms may apply and which will be outlined at sign-up and made available to you prior to purchase (“Add-On Event”). In certain territories, we also offer our free to watch subscription for which additional terms may apply and which will be outlined at sign-up and made available to you prior to subscription (“Free Subscription”). You can find specific details regarding your subscription plan by visiting your account on Sky.
2.3. The DAZN Service is an online video service, together with the DAZN Events on Sky through which we make available to you at our selection varying audio-visual coverage of sporting events (both live and, where applicable, replays), audio-visual highlights of sporting events and related content (collectively "Content"). The DAZN Service does not include any specific, unchanging content; rather, due to the periodic re-licensing by our licensors, the specific content included in the DAZN Service is subject to occasional change, for example, as existing licences expire, or new licences are obtained. The Content is subject to certain territorial restrictions i.e., each territory will have different rights available, a catalogue of rights available to you on the DAZN Services in your territory can be seen on the home page of the DAZN site.
2.4. Individual, selectable content of the DAZN Service will be made available on the Sky Switzerland OTT Platform ("DAZN Events on Sky"). The DAZN Events on Sky cannot be used individually (e.g. as part of pay-per-view), but only with an existing subscription to the DAZN Service. Access to the DAZN Events on Sky requires a residence in CH and access to the Sky Switzerland OTT Platform. In this respect, the general terms and conditions of Sky ("Sky GTC") apply. In the event of a conflict between these Terms and Conditions and the Sky GTC, these Terms and Conditions shall take precedence. The provision of Sky's technical infrastructure necessary for the provision of the DAZN Events on Sky is not the subject of this contract. In the event of termination of the separate contract with Sky, regardless of the reason and whether by you or by Sky ("Sky Termination"), access to DAZN Events on Sky will cease.
2.5. You will be required to register an account to enjoy the DAZN Service. To register an account:(a) you will be asked to provide certain information (such as your email address) and create a password; and (b) you may be asked to verify the information you have provided, as part of our and/or Sky’s security procedures. If you elect to make any changes to the details you provided when you registered the account, you may be asked to verify the information you have provided as part of our or Sky’s security procedures.
2.6. Unless otherwise specified in your subscription plan at sign-up, your account details incl. your password are personal to you and must not be shared with anybody or made accessible to others.
2.7. You may access the DAZN Service only in the country in which you have established your DAZN account and only steam the Content available in that country.
2.8. The DAZN Service, the DAZN Events on Sky and any Content viewed through the DAZN Service are for your personal and non-commercial use only. When you are a subscriber, we grant you a limited, non-exclusive, non-transferable, license to access the DAZN Service and to view the Content made available to you (depending on the subscription plan you have) on a streaming-only basis. Except for the foregoing limited license, no right, title, or interest is granted or transferred to you. You agree not to use the DAZN Service for public performances.
2.9. In the event that you culpably breach your obligations under sections 2.8 or 9.1.1, in particular by making the Content publicly available in gastronomic establishments where food and/or beverages are sold (e.g. restaurants, bars, hotels, clubhouses) or in gaming arcades, fitness studios or hospitals, we are entitled to levy a contractual penalty of EUR 2,500.00 for all breaches which were proven within the last 12 months before the contractual penalty was levied. The contractual penalty is also payable if you culpably enable a third-party to make their content publicly available by providing the third-party with your user account required to access the DAZN Service. The enforcement of the contractual penalty is without prejudice to any further claims for damages, whereby the contractual penalty paid is to be offset against the damages based on the same breach.
2.10. Any Paid Subscription with us is conditional on any required payment due from time to time being authorised by your supported payment provider or, if applicable, your subscription code or promotional code being valid and is at all times subject to these Conditions.
3. Right of modification
3.1. We reserve the right to modify provisions of these Conditions subject to the requirements set out below if such amendment is reasonable for you considering our interests and we have a reason for amending these Conditions.
3.2. Expressly excluded from the ability to amend these Conditions is any amendment which would result in a change in the nature of our main contractual obligations. In such a case, we will notify you of the changes to the Conditions and offer to continue the contractual relationship under the then changed Conditions.
3.3. A reason for the change in accordance with Section 3.1 exists,
(i) if the change is merely advantageous to you;
(ii) if the change is purely technical or procedural, unless it has a material impact for you;
(iii) to the extent that we are required to bring the Conditions into compliance with applicable law, in particular where there is a change in applicable law;
(iv) to the extent that we introduce additional services, features or service elements that require a description in the Conditions, unless your existing usage relationship is adversely affected thereby.
3.4. You will be notified of any changes to these Conditions on the basis of the reservation of our right to modify in Section 3.1 (with the exception of changes to the Content pursuant to Section 2.3) by e-mail to the last registered e-mail address at least 30 days before the changes take effect. The changed Conditions shall be deemed accepted, if you do not object via e-mail, to the e-mail address that will be provided in the according notification of the changes, to the validity of the changes to these Conditions within 30 days of receipt of our notification,. We will inform you separately of the significance of this period in the aforementioned e-mail (in particular, that you will be deemed to have accepted the amended Conditions if you do not object to the amended Conditions within the period after receipt of the e-mail). Your right to terminate the contract in accordance with Section 7 remains unaffected.
4. Privacy
4.1. Our privacy policy is available at https://www.dazn.com/en-DE/help/articles/privacy-de (“Privacy Policy”). Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our regularly updated Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information. We recommend that you visit this website regularly to inform yourself about possible updates to our Privacy Policy.
5. The Financials
5.1. Your payment will only cover access to the DAZN Service and, where applicable, the content covered by the relevant subscription model or booked Add-On Events. You are fully responsible for all charges relating to and equipment required for use of the DAZN Service. Telephone line and other communications or access costs may be charged to you separately by your ISP or relevant service provider. All our prices are inclusive of tax (VAT/ MwSt / CT or any similar tax in any other territory or jurisdiction) at the rates in force from time to time.
5.2. The price for the DAZN Service relates solely to your access to the DAZN Service. The DAZN Events on Sky are a free additional option to your subscription to the DAZN Services. The use of the DAZN Events on Sky therefore has no influence on the price for the DAZN Service and DAZN reserves the right to discontinue the provision of the DAZN Events on Sky anytime without being liable to you.
5.3. Payment for a Paid Subscription and/or an Add-on Event must be made by an accepted payment method in your country as identified during sign-up, for example credit card; PostFinance card, Swisscom Pay, Sunrise invoicing or through another current, valid, method of payment accepted by Sky including supported third-party payment providers (“Payment Method”). The Payment Methods available will vary depending on the country in which you sign up to the DAZN Service. You confirm that any such Payment Method that you use is yours, or that you have the authorisation of the card or account holder to use it. All accounts and payments are subject to validation checks and authorisation by the Payment Method provider. If your payment is refused, then you will not be granted access to the DAZN Service until a validated Payment Method is provided by you and approved by us. In the event of a payment not being processed or being recalled without authorisation for reasons for which you are responsible, we may charge you the costs incurred as a result, e.g. for the bank return debit charge.
5.4. For some Payment Methods, the issuer of your Payment Method may charge you certain fees, such as a foreign transaction fee or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
5.5. We reserve the right to refuse to accept payments if there is a valid reason, including if we have concrete grounds to suspect fraudulent and/or illegal activity.
5.6. Subject to Section 5.10 the fee for a Paid Subscription and/or Add-On Event will be as outlined when you sign-up or in other communications made available to you prior to your purchase. The fee for a Paid Subscription is billed on a monthly, annual or other basis, as chosen by you at sign-up to the DAZN Service, to your chosen Payment Method on the calendar day corresponding to the commencement of your Paid Subscription or as otherwise specified by the issuer of your Payment Method. If you are in default of payment of the monthly fees by more than a small amount, we may exercise our statutory rights to refuse performance and withdraw access to the DAZN Service for the duration of the default in payment and/or refuse the use of further services for that period. Further purchases will not be possible until the end of the payment default. Our right to terminate without notice for cause in accordance with Section 8.2 remains unaffected.
5.7. If you have signed up for a Paid Subscription with a minimum term of at least 3 months, in the event of a default in payment of either two consecutive months or of a total amount exceeding your applicable subscription price for two months, all outstanding payments up to the end of the minimum term will become due immediately, i.e. upon the occurrence of the default, and will be billed by us via your chosen Payment Method.
5.8. The fee for an Add-On Event is billed immediately to your chosen Payment Method on purchase of the Add-On Event.
5.9. In some cases, the date for billing, carried out by Sky, may change, for example if your subscription began on a day not contained in a given month.
5.10. All payments shall be made with discharging effect towards Sky.
5.11. We reserve the right to adjust the price for the Paid Subscription and/or Add-On Events in CH after the conclusion of the contract to changing market conditions to the extent that the delivery costs for the market relevant (i.e. Swiss or Liechtensteinian) for the calculation of these prices ("Total Costs") substantially increase and we are unable to compensate for this increase by balancing it with declining other cost factors ("Total Cost Increase").
Our basis of assessment for determining the Total Costs are changes in the following cost elements, whereby the impact of the individual cost element on our calculation of the Total Costs decreases from left to right: fees for sports broadcasting licences , costs for the technical provision of the DAZN Service (in particular increased energy and production costs), costs for customer service and other revenue costs, general administrative costs, government-imposed fees, levies and taxes (excl. VAT), as well as wages (incl. tariff wages). We can only adjust the price for the Paid Subscription and/or Add-On Events by an amount necessary to offset a Total Cost Increase. An increase in the price of Paid Membership and/or Add-On Events cannot be made to generate additional profit. We also undertake to pass on reductions in Total Costs to you.
5.12. Regardless of this, in the event of significant changes in the consumer price index of the Federal Statistical Office (a significant change is deemed to be an increase of 0.5 percentage points or more compared to the same period of the previous year) or an increase in the statutory value added tax payable on the price for the Paid Subscription and/or Add-On Events to be paid by you DAZN is entitled and in the event of a reduction of the same, obliged, to adjust the price for the for the Paid Subscription and/or Add-On Events accordingly.
5.13. Any price increase for the Paid Subscription and/or Add-On Events shall apply at the earliest after thirty (30) days as of our email notification to your most recently registered email address.
5.14. If a price increase made under the requirements of Sections 5.10 or 5.11 is more than 5% of the price applicable up to the date of the increase, you will be entitled to terminate the contract at any time within the thirty (30) days from the date of receipt of our notice of the increase with effect from the date on which the increase takes effect. If you do not terminate the contract or do not terminate it in time, the contractual relationship will be continued at the time stated in the notification with the changed price. Your general right of termination pursuant to Section 6 remains unaffected.
6. Conclusion of the contract, Term, Renewal and Termination
6.1. Our product offers are free of obligation and do not constitute a legally binding offer. By activating the order button, you submit a legally binding offer to conclude a subscription contract. The contract is concluded by Sky’s explicit confirmation of the contract. If you have not received such a confirmation, the contract is concluded when we provide you with access to the Content in digital form.
6.2. Your Paid Subscription begins on the day of the conclusion of the contract and runs, depending on the type of subscription you have chosen, for a month (“Monthly Subscription”) or a year (“Annual Subscription”) Your Paid Subscription can be terminated at any time either by you or by us with a notice period of thirty (30) days.
Your Paid Subscription can be terminated for the first time with a notice period of thirty (30) days to the end of the contract term. If your paid membership has not been terminated at the end of the contract term, your paid membership will be renewed on a recurring basis for the duration of the initial contract term (i.e. one month for a monthly membership and one year for an annual membership) at the conditions communicated during the sign up process.
6.3. If after a notice of termination is given, your subscription is active beyond the last complete billing period, we will bill a pro rata amount based on the number of days after the last billing date to your chosen Payment Method. The regular billing period always starts on the day of the month that corresponds to the day of your sign-up for the Paid Subscription and ends on the day that precedes the day of your signed up for the Paid Subscription in the following month.
6.4. Your Free Subscription, your subscription generally has an indefinite term. We can terminate your Free Subscription at any time via email with a notice period of 7 days. You may cancel your Free Subscription at any time by emailing help@dazn.com requesting ‘Close my account’. A DAZN customer service agent will then action this in no more than 10 working days.
6.5. Your termination must be made by declaration in text form and can be made on Sky’s website sky.ch.
6.6. If you signed up for a Paid Subscription via a third-party and/or using your account with a third party as a Payment Method and wish to terminate your subscription to the DAZN Service, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the DAZN Service through that third party. You may also find additional billing information about your subscription to the DAZN Service by visiting your account with the applicable third party.
6.7. The provisions on the right to termination for cause remain unaffected.
7. Technical Requirements
7.1. You are responsible for ensuring that you have and maintain all the hardware, software and connectivity (such as broadband) necessary to access, receive and view the DAZN Service and the DAZN Events on Sky.
7.2. From time to time we may need to suspend the DAZN Service to carry out upgrades or maintenance. We will try to keep any such suspension to a minimum.
7.3. We will provide the DAZN Service with reasonable care and skill (according to our statutory and contractual obligations). Except within the boundaries of Sections 8.4 and 13 below, we will not have any liability to you for the cancellation or the abandonment of any event not with our responsibility or the failure to show any event as scheduled or advertised, nor where you are unable to watch any event on any specific platform device. This does not affect any statutory warranty rights for digital products you may have as a consumer. We (and not any third-party payment provider) are responsible for addressing any claims you or any third-party may have in relation to the DAZN Service and/or your use of the DAZN Service.
7.4. In circumstances where there has been any failure of the DAZN Service to conform to any applicable warranty and you believe you are entitled to a refund, please contact Sky with regards to the failure. Sky will process your request for us and may refund any applicable purchase price for the DAZN Service to you on our behalf.
7.5. You are not entitled to access Content in HD format, unless outlined otherwise at sign-up to the DAZN Service. The maximum resolution quality available (e.g. SD, HD or UHD) may vary for technical and licensing reasons, depending on the Content. We reserve the right to restrict access to Content in HD or UHD format or charge an additional fee depending on your subscription plan chosen at sign-up.
7.6. The quality of the display of the streaming of sport events may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. A minimum download speed of at least 9.0 Mbps per stream is recommended to receive available HD content, which is defined as 720p or better. You should check with your ISP for information on possible Internet data usage charges. We will support a minimum bitrate of 800kps in all television devices which use the DAZN Service.
7.7. The streaming software used to deliver the DAZN Service may vary by device and medium, and functionalities may also differ between devices. You acknowledge that the use of the DAZN Service may require third party software that is subject to third party licenses.
7.8. A list of devices that the DAZN Service can be used on can be accessed via our FAQ’s in the ‘supported devices’ section and you should check the list prior to using the DAZN Service.
8. Using the DAZN Service
8.1. We are the owner or licensee of all intellectual property rights in the DAZN Service (including any Content). All material, including but not limited to the design, text, software, graphics, footage and images you receive (and any selection or arrangement) are subject to the copyright of us and/or others. In the event of any third-party claim that the DAZN Service or your use of the DAZN Service infringes that third party’s intellectual property rights, we (and not a third party payment provider) are solely responsible for the investigation, defence, a potential settlement and potential discharge of such claim.
You undertake that you will:
8.1.1. use the DAZN Service for non-commercial purposes only without making any gain, whether financial or otherwise, and that you will not permit any other person or persons to use the DAZN Service. You must not charge for viewing of the DAZN Service and you cannot use the DAZN Service to attract others to buy goods from you or anyone else or to attend any premises;
8.1.2. at any given time, only view the DAZN Service via a permitted device. You must keep your password secure and never share passwords or other access codes with anyone or in any way make them accessible to others (unless otherwise (and only to the extent) stated in your subscription plan);
8.1.3. not copy, record or store all or any part of the DAZN Service (other than as permitted by us in the application functionality) or divert, re-share, re-transmit, stream capture or otherwise distribute all or any part of the DAZN Service to any person, or authorise, enable or procure any other person to do any of the above;
8.1.4. not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials or information through any means not purposely made available through the DAZN Service;
8.1.5. not alter, disassemble, decompile or reverse engineer any part of the DAZN Service;
8.1.6. not embed the DAZN Service into any website, other service or display the contents of the DAZN Service surrounded or framed or otherwise surrounded by material not originating from us without our consent;
8.1.7. not view the DAZN Service in circumstances where members of the public can view them simultaneously or authorise, enable or procure any other person to do so; and
8.1.8. not abuse the DAZN Service or use them for any unlawful or unauthorised purpose (which includes transmitting any computer viruses through the site, or using the site in a manner which violates or infringes the rights of anyone else).
8.2. We may suspend your access to the DAZN Service, terminate your subscription for cause or withdraw your access to any promotions, offers or discounts if we have reasonable grounds to believe:
8.2.1. your use of the DAZN Service is abusive, disruptive, excessive or against the interests of other subscribers; or
8.2.2. there has been a breach of security on your account;
8.2.3. you are in breach of any of these Conditions;
8.2.4. we are requested to do so by a regulatory authority; and/or
8.2.5. we are required, or believe that it is necessary, to do so under applicable laws;
and we have unsuccessfully given you a warning and/or set you a time limit to remedy the breach. A warning or the setting of a time limit in accordance with this clause 9.2 is not necessary if there are special circumstances which, taking into account the interests of both parties, justify the immediate assertion of our rights in accordance with this clause 9.2 or if the law permits otherwise.
8.3. Your subscription entitles you to stream Content using the DAZN Service on one (1) device at any one time. Depending on your subscription plan the permitted number may be higher, in which case you are entitled to stream Content on such higher number outlined at sign-up or in other communications made available to you prior to purchasing the subscription plan.
8.4. In accordance with Section 9.1.2 above, you agree that the login details are unique to you and should not be shared with any other person. You can change your login details at any time by visiting our website and clicking on the "My Account" page and you may be asked to verify the information you have provided as part of our security procedures.
9. Your Security Protection
You should be mindful of any communication requesting that you submit credit card or other account information. Providing your information in response to these types of communications can result in identity theft. Always access your sensitive account information by going directly to the DAZN Service and not through a hyperlink in an email or any other electronic communication, even if it looks official.
10. Age Restriction, Youth Protection
10.1. You must be the older of 18 years of age (or over), or the age of majority in your state, province or territory of residence, to become a user of the DAZN Service.
10.2. You are obliged to comply with the requirements for youth protection. Content that is only released for adults (FSK 18) may not be made accessible to children and adolescents. For access to the corresponding age-restricted content, a one-time proof of age and the according unlocking is required before you can start streaming. You can provide proof of age on our website under the menu item "Settings" in the section " Youth Protection" and select an individual youth protection PIN, which you can also change at a later date. You must keep the youth protection PIN secret. It is forbidden to pass on the youth protection PIN to minors and third parties. For DAZN Events on Sky, deviating access regulations may be defined in the Sky GTC.
11. Indemnity
11.1. You agree to fully compensate us in respect of any damages, costs and expenses (including reasonable legal fees) that we incur as a result of:
11.1.1. any negligent or willful misrepresentation, act or omission made by you in connection with your use of the DAZN Service;
11.1.2. any negligent or willful non-compliance by you with these Conditions; or
11.1.3. claims brought by third parties arising from or related to your negligent or willful access or use of the DAZN Service other than in accordance with these Conditions.
11.2. Damages within the meaning of Section 12.1. also comprise liabilities that we have towards our affiliates or our (including our affiliate’s) licensors (including their affiliates) due to any of the events described in Sections 12.1.1. – 12.1.3.
12. Liability
12.1. Subject to Section 13.2., the maximum liability of each of us and any third-party right holder to you arising by reason of or in connection with the supply of the DAZN Service to you shall be limited to such damage as typically foreseeable in the event of a slightly negligent breach of a material contractual duty under these Conditions. A “material contractual duty” under these Conditions is a duty the fulfilment of which is essential for the proper execution of these Conditions, the breach of which endangers the purpose of these Conditions and on the fulfilment of which you regularly rely. Loss or damage is “typically foreseeable” if it was typically foreseeable at the time that you accepted these Conditions. We exclude our and any third-party rights holder’s liability for damages caused by a slightly negligent breach of a non-material contractual duty.
12.2. Nothing in these Conditions shall exclude or limit the liability of us and/or any third-party rights holder for gross negligence or willfulness or for death or personal injury or for its fraud. Likewise, your potential further mandatory statutory rights as a consumer shall remain unaffected.
12.3. Where the DAZN Service contains links to sites and resources provided by third parties, we have no control over the contents of those sites, resources or services. Any use of such third-party sites, resources or services will be covered by that third party's terms and conditions and privacy policy, and we accept no responsibility for them or for any loss or damage that may arise from your use of them.
13. Contact Us
13.1. You can contact us whether to discuss technical problems with the DAZN Service or for any other reason by using the “Help” form or the “contact us” page on our website. In order for us to be able to assist you, you may be required to provide your email address, residential address, product details, payment information, which may include your billing address in order to assist you or to identify your subscription. We (and not any third-party payment provider) are responsible for providing all maintenance and support with respect to the DAZN Service.
13.2. If you subscribe to the DAZN Service, you should notify us immediately if any of your details change by updating these details in the “My Account” section of our website or through the application.
13.3. Any notice given by us will be given by email via the most recent email address we hold for you. We shall not be responsible for non-receipt of messages we send you.
14. Third-Party Applications
You may encounter third party applications (including, without limitation, websites, widgets, software, or other software utilities) ("Applications") that interact with the DAZN Service. Your use of these Applications may be subject to third party terms of use or license terms with which you must comply. We shall not be responsible nor liable in any way, for the terms of any third-party applications you may use in conjunction with the DAZN Service.
15. Force Majeure
Neither us nor any third party rights holder shall have any liability to you for any delay or failure to deliver the DAZN Service to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of us or any third party rights holder including, but not limited to, the failure of electronic or mechanical equipment or communication lines, third party action (including denial of service attack and overuse or misuse of the DAZN Service), telephone or other interconnect problems, computer viruses, unauthorised access, theft, operator errors, fire, severe weather conditions, including floods, acts of God, acts or regulations of any regulatory, governmental or supranational authority, war, riot, industrial disputes and the cancellation or postponement of any event.
16. Waiver
No waiver by us or any third-party rights holder shall be construed as a waiver of any rights or remedies, or any subsequent breach of any provision of these Conditions.
17. Third Party Rights
17.1. Sections 2, 7, 9, 13, 14, 16, and 17 confer a benefit on third party rights holders and payment providers and are intended to be enforceable by third party rights holder and payment providers. Except as provided in this Section 18 no person who is not a party to the contract governed by these Conditions has no rights to enforce any provision of these Conditions but this does not affect any right or remedy of a third party which exists or is available under mandatory applicable law.
17.2. You shall have no right to make use of any names, words, symbols, emblems, logos, slogans, designs, program titles or depictions, trade dress, colours and helmet and uniform designs of third party rights holders (for example, the National Football League or its member clubs). These rights holders, including NFL International LLC and its affiliates may enforce violations of these Conditions with respect to their respective intellectual property rights directly against you.
18. Assignment
Subject to the following sentence of this Section 19, we may transfer our rights under these Conditions without notifying you or obtaining your consent or make use of sub-contractors to fulfil our obligations.
In the event of a transfer of the contract with you to a third party, we will notify you of the transfer. Subject to the condition precedent that such a transfer to a third party has occurred, you will have the right to terminate the contract without observing a notice period by declaration to us within four (4) weeks as of your receipt of our notification.
You may not transfer any right granted in accordance with Section 2.7 to a third party.
19. Severability
If a provision of these Conditions is determined to be unlawful and/or unenforceable, the validity of the rest of the Conditions shall remain unaffected.
20. Governing Law and Language
These Conditions shall be exclusively governed by and construed in accordance with the laws of Switzerland to the extent permitted by law. Mandatory consumer protection law of your country shall remain unaffected.
This English version of these Conditions will only be published as a matter of translation. In case of any inconsistencies of conflict between the German version and the English version of these Conditions the German version shall prevail.
21. Dispute resolution proceedings
We do not wish to take part in dispute resolution proceedings before a consumer arbitration board and are not legally required to participate in such proceedings. We prefer to solve your requests directly with you. For this purpose, please use the “Help” form on our website.
